Are the Jenner Sisters Being Sued for Trademark Infringement?

Sisters Kylie and Kendall Jenner are facing something new and no, it’s not another campaign or endorsement—it’s a probable lawsuit. California-based lifestyle clothing brand Pacific Sun (PacSun), where the two served as celebrity collaborators this year is being sued by Florida-based brand Island Company for stealing their motto, “Quit your job; buy a ticket; get a tan; fall in love; never return.”

The line is the brand’s trademark, which was registered since 2010 and has been used on their items even five years prior. The Jenners’ 2015 collaboration with PacSun features a cami tank top with text that strikingly resembles that of Island Company’s motto. “Run away; fall in love; never return” are written on the tank top.

Island Company believes that such a striking resemblance is “likely [to] cause confusion, mistake, and deception among consumers and the public.” Furthermore, the case where PacSun and the Jenners “will continue to make substantial profits and/or gains to which they are not entitled” is something that they hope to prevent.

An immediate termination of the product was already requested by Island Company. The item was readily pulled out from PacSun’s website but can still be seen here. In addition, they are also requesting to be paid for damages as a result of the whole ordeal.

No comments from either PacSun or from Kylie and Kendall have been released as of press time.
